These Terms of Service (“Terms”) govern your access to and use of EcomHub websites, Shopify themes, digital products, licensing services, subscriptions, support services, and related products and services (collectively, the “Services”).
By purchasing, downloading, activating, accessing, or using an EcomHub product or Service, you agree to these Terms. If you do not agree, do not purchase, download, activate, or use the Services.
1. EcomHub Products
EcomHub provides digital products designed primarily for use with Shopify, including products such as:

EcomHub Pro
-
EcomHub Lite
-
Theme licenses
-
Theme updates
-
Related downloadable files, documentation, and digital resources
Features may vary between products, editions, and versions.
The features included with your purchase are those advertised for the applicable product and version at the time of purchase.
2. Digital Product Delivery
EcomHub themes and related products are digital products.
After successful payment, you may receive access to downloadable theme files, license information, installation instructions, or other digital materials.
You are responsible for providing accurate information during checkout and maintaining access to the email address or account associated with your purchase.
Delivery is considered complete when the purchased digital product or access instructions are made available to you.
3. Theme License
Purchasing an EcomHub theme does not transfer ownership of the underlying theme software, source code, intellectual property, branding, or associated systems.
Instead, your purchase grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased theme in accordance with these Terms and the license package purchased.
Your license may be limited by:

Theme edition
-
Number of Shopify stores
-
Number of permitted activations
-
Other restrictions disclosed at the time of purchase
For example, a one-store license permits use on one eligible Shopify store. Multi-store packages permit use only up to the number of stores included with that package.
Each additional store beyond your purchased allowance requires an additional license or appropriate multi-store license.
4. EcomHub Pro and EcomHub Lite
EcomHub may offer multiple editions of its themes with different functionality.
EcomHub Pro and EcomHub Lite are separate product editions.
Purchasing EcomHub Lite does not grant access to EcomHub Pro or Pro-exclusive functionality.
Purchasing EcomHub Pro may provide different features and licensing privileges as described on the applicable product page.
EcomHub may use technical licensing controls to determine whether a license is authorized to activate a particular theme edition.
Attempting to circumvent edition restrictions or enable functionality for which you have not purchased the appropriate license is prohibited.
5. Permitted Use
Subject to these Terms and your applicable license, you may:

Install the theme on an authorized Shopify store.

Customize the theme for that authorized store.
-
Modify theme settings and content.
-
Make reasonable code modifications for your own authorized storefront.
-
Create backup copies for your own legitimate use.
-
Use the theme commercially on stores covered by your license.
Customizing or modifying an EcomHub theme does not transfer ownership of the original theme or create a right to redistribute it.
6. Prohibited Use
You may not, without our express written permission:

Share your theme files with unauthorized persons.
-
Sell, sublicense, rent, lease, distribute, or give away EcomHub theme files.

Publish the theme source code for public download.
-
Upload the theme to theme-sharing or file-sharing websites.
-
Use a single-store license across multiple stores.
-
Share, sell, transfer, or publicly disclose license keys.
-
Circumvent, disable, manipulate, bypass, or interfere with licensing or activation systems.
-
Modify the theme for the purpose of defeating license enforcement.
-
Forge, manipulate, or impersonate licensing-server responses.
-
Remove or circumvent technical restrictions separating EcomHub editions.
-
Claim ownership of EcomHub's underlying theme framework or proprietary code.
-
Resell a modified EcomHub theme as your own standalone theme product.
-
Use EcomHub intellectual property in a way that falsely implies endorsement or affiliation.
Unauthorized distribution or circumvention may result in license suspension or termination.
7. License Verification
EcomHub themes may communicate with EcomHub licensing infrastructure to activate or validate a license.
License verification may process technical information necessary to determine whether a theme installation is authorized, such as:

License identifier

Theme edition
-
Theme version
-
Shopify store/domain information
-
Activation status
-
Validation information
-
Relevant technical request information
License information is handled in accordance with our Privacy Policy.
The licensing system may periodically verify continued authorization to use licensed functionality.
8. License Suspension and Termination
We may suspend or terminate a license where we reasonably determine that:

A license is being used beyond its permitted activation limit.
-
A license has been fraudulently obtained.
-
Payment for the applicable purchase has been reversed or successfully disputed.
-
A license key has been publicly shared or distributed.
-
Theme files have been unlawfully redistributed.
-
Licensing protections have been deliberately circumvented.
-
The Services are being used in material violation of these Terms.
Where appropriate and reasonably possible, we may provide an opportunity to resolve a licensing issue before permanent termination.
Termination of a license does not entitle you to a refund except where required by applicable law or expressly provided under our Refund Policy.
9. Theme Updates
Your original theme purchase includes the version of the theme made available as part of that purchase and any other update rights expressly stated at checkout.
Future updates are not automatically included unless expressly stated.
EcomHub may offer an optional Monthly Theme Updates subscription.
While eligible for updates, customers may receive access to newer theme versions containing features such as:

Bug fixes
-
Improvements
-
Compatibility updates
-
Performance improvements
-
New functionality
-
Design enhancements
We do not guarantee any particular update schedule, feature, or future release.
10. Monthly Theme Updates Subscription
If you purchase Monthly Theme Updates, the subscription will renew at the frequency and price disclosed at checkout unless canceled.
You may cancel the subscription to prevent future renewals.
Cancellation generally does not provide a refund for a billing period that has already begun, subject to applicable law and our Refund Policy.
Canceling Monthly Theme Updates does not automatically terminate your underlying theme license. You may continue using theme versions you were legitimately entitled to receive, subject to these Terms.
After your update entitlement ends, you will not be entitled to theme versions released outside your eligible update period unless you renew or otherwise purchase access.
11. Theme Updates and Customizations
Installing a newer version of an EcomHub theme does not normally delete Shopify-managed information such as your products, orders, or customers.
However, Shopify themes are separate packages, and custom theme code, settings, templates, integrations, or other modifications may not automatically transfer between versions.
You are responsible for maintaining backups of custom code and important theme configurations before installing or modifying a theme.
EcomHub is not responsible for lost custom modifications caused by replacing, updating, editing, or improperly installing theme files.
12. Shopify and Third-Party Applications
EcomHub is an independent product and is not Shopify unless expressly stated otherwise.
Shopify is a third-party platform governed by its own terms, policies, technical requirements, and availability.
EcomHub themes may support Shopify app blocks and third-party applications, but we cannot guarantee compatibility with every current or future application.
Third-party applications may modify storefront code, inject scripts, alter styles, or otherwise affect theme functionality.
EcomHub is not responsible for issues caused solely by third-party applications, services, custom code, or modifications outside our control.
13. Support
EcomHub may provide support for eligible theme-related issues.
Support may include reasonable assistance with:

Theme installation
-
License activation
-
Built-in EcomHub functionality
-
Reproducible theme errors
-
General guidance regarding included theme features
Unless expressly included with your purchase, support does not include:

Building your store for you
-
Custom feature development
-
Extensive custom coding
-
Third-party app development
-
Fixing unrelated third-party applications
-
Marketing or advertising services
-
General Shopify consulting
Support availability, response times, and scope may change.
14. Refunds
Because EcomHub products are digital products that may be delivered immediately, purchases are generally final once the product has been delivered or made available for download.
Refund eligibility and exceptions are governed by our separate Refund Policy.
Nothing in these Terms limits rights or remedies that cannot legally be excluded under applicable consumer-protection laws.
15. Intellectual Property
EcomHub themes, source code, designs, graphics, documentation, branding, logos, licensing technology, and other proprietary materials are owned by EcomHub or its applicable licensors and are protected by intellectual-property laws.
Except for the limited license expressly granted under these Terms, no ownership rights are transferred to you.
“EcomHub” and associated branding may not be used in a way that falsely suggests that another product, company, or service is operated, sponsored, or endorsed by EcomHub.
16. Customer Content
You retain ownership of content that you add to your Shopify store, including your own:

Product information
-
Images
-
Videos
-
Logos
-
Written content
-
Brand assets
You are responsible for ensuring that you have the necessary rights to use content uploaded to your store.
EcomHub does not acquire ownership of your storefront content merely because you use an EcomHub theme.
17. Availability and Changes
We may modify, improve, discontinue, or replace portions of our Services and future versions of our products.
We may also change features between theme versions or editions.
We do not guarantee that every feature will remain unchanged indefinitely.
Where practical, material changes affecting purchased products will be handled in a manner consistent with applicable law and existing contractual obligations.
18. Disclaimer of Warranties
To the fullest extent permitted by applicable law, EcomHub products and Services are provided on an “as is” and “as available” basis.
We do not guarantee that:

Your store will generate sales or revenue.
-
Using EcomHub will increase conversion rates.
-
Your business will achieve any particular result.
-
Every third-party app will be compatible.
-
The Services will operate without interruption or error.
-
Every feature will remain compatible with every future Shopify change.
Examples, demonstrations, marketing materials, and storefront previews illustrate theme capabilities and do not guarantee business performance.
19. Limitation of Liability
To the fullest extent permitted by applicable law, EcomHub will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services, including loss of profits, revenue, data, business opportunities, or goodwill.
To the fullest extent permitted by applicable law, EcomHub's aggregate liability arising from a particular purchase or use of a product will not exceed the amount you paid to EcomHub for the product or Service giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold EcomHub and its owners, affiliates, employees, contractors, and service providers harmless from claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, infringement of third-party rights, or content you provide through your storefront.
21. Fraud and Chargebacks
If you believe there is a problem with your purchase, please contact EcomHub Support so we have an opportunity to address the issue.
Fraudulent purchases, unauthorized payment activity, or abusive payment disputes may result in suspension of associated licenses or accounts where permitted by law.
Nothing in this section prevents a customer from exercising legitimate rights to dispute an unauthorized or otherwise legally disputable transaction.
22. Governing Law
These Terms will be governed by the laws applicable to EcomHub's legal business entity and principal place of business, without regard to conflict-of-law principles, except where mandatory consumer laws require otherwise.
Before publishing these Terms, EcomHub should identify the applicable jurisdiction and legal business entity in this section.
23. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
24. No Waiver
Failure by EcomHub to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
25. Changes to These Terms
We may update these Terms periodically.
When changes are made, the “Last Updated” date will be revised. Where required by applicable law, we will provide additional notice of material changes.
Your continued use of the Services after updated Terms become effective constitutes acceptance where permitted by applicable law.
